8th Circuit Amicus Brief

The Justice Foundation Files Friend of the Court Brief in
Support of South Dakota's Informed Consent Statute
 

The Justice Foundation has filed a Friend of the Court ("Amicus") Brief on behalf of 2,211 women injured by abortion in the 8th Circuit Court of Appeals.  The 2,211 women are some of the women of Operation Outcry who have submitted their legally admissible testimony (Declarations/Affidavits).  These women's testimonies support South Dakota's findings that the consequences of abortion include severe depression, anxiety, suicidal thoughts and attempts, and substance abuse. Planned Parenthood is arguing that abortion has no such negative consequences, and that women considering abortion should not be informed of such potential consequences.

 

We believe this is the largest group of post-abortive women who have ever been represented in court.

These women's testimonies support South Dakota's findings that the consequences of abortion include severe depression, anxiety, suicidal thoughts and attempts, and substance abuse. Planned Parenthood is arguing that abortion has no such negative consequences, and that women considering abortion should not be informed of such potential consequences.
 
The case will be heard by the Eighth Circuit Court of Appeals, who two years ago upheld a statute requiring women to be informed in writing that abortion terminates the life of a human being.  The Eighth Circuit Court referenced Operation Outcry testimony in upholding the statute, citing the Supreme Court opinion that cited The Justice Foundation's brief while upholding the partial-birth abortion ban.
                                                          
This case has the potential to go all the way to the Supreme Court.  This brief and case play a vital role in a decision that will be pivotal in setting precedent to protect women from the harm caused by abortion.
